Article 1 - Purpose
These Terms of Use (hereinafter "ToU") define the terms and conditions of use of the services offered by The Gifts Club SAS (hereinafter "The Gifts Club" or "the Company"), as well as the rights and obligations of users (hereinafter "the User").
Access to the TheGiftsClub.io website and associated services implies unreserved acceptance of these ToU.

The Gifts Club is published by The Gifts Club SAS, a company with a share capital of €10,000, registered with the Paris Trade and Companies Register under number 982 315 152, with its registered office at 10 rue de Penthièvre, 75008 Paris, France.

Article 3 - Description of services
The Gifts Club offers a SaaS loyalty and gamified marketing solution enabling client businesses to:
- Organize in-store activities in the form of games
- Collect customer data for marketing campaigns
- Encourage customers to interact on social media and leave online reviews
- Offer rewards under certain conditions defined by the client business
The User can access the services through a personal account and a secure space.
Article 4 - Access to the service
4.1 Access conditions
Access to the services is reserved for persons of legal age and with full legal capacity. The User must have Internet access and a compatible device.
4.2 Account creation
To use certain features, the User must create an account by providing accurate and up-to-date information. The User is solely responsible for the confidentiality of their login credentials.
4.3 Availability and maintenance
The Gifts Club guarantees 99.9% service availability, excluding force majeure or scheduled maintenance.
Service interruptions for maintenance will be announced at least 48 hours in advance.
Article 6 - Use of the service and security
The User agrees to:
- Not use the services for fraudulent, illegal or immoral purposes
- Not disrupt the proper functioning of the website and services
- Respect the rights of third parties and applicable laws
In case of violation of the ToU, the Company may suspend or delete the User's account without notice or compensation.
Article 7 - Data protection and confidentiality
The Gifts Club processes personal data in accordance with its Privacy Policy and in compliance with the GDPR.
The User has the following rights:
- Access, rectification and deletion of data
- Objection and restriction of processing
- Data portability

Article 8 - Liability
8.1 Liability of The Gifts Club
The Gifts Club is committed to providing a high-performance service, but cannot be held liable in case of:
- Temporary service interruption
- Data loss due to misuse of the service
- Indirect damages suffered by the User
8.2 Liability of the User
The User is responsible for their use of the service and the information they publish.
Article 9 - Intellectual property
All content on TheGiftsClub.io is protected by intellectual property rights belonging exclusively to The Gifts Club SAS.
Any reproduction, exploitation or distribution without prior authorization is prohibited.
Article 10 - Modifications to the ToU
The Gifts Club reserves the right to modify these ToU at any time. The User will be informed of changes by any appropriate means (website notification, email...).
Continued use of the service after modification constitutes acceptance of the new ToU.
Article 11 - Applicable law and jurisdiction
These ToU are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution before taking legal action.
Failing agreement, any dispute shall be submitted to the Commercial Court of Paris.
